Terms and Conditions

 Who are We

Final Farewell Films and our trading office is at 14 Westbrook Terrace, Tunbridge Wells, Kent TN2 5BP.

Final Farewell Films is a trading name of Anneka Ireland Videography (“Us” or “We”) offers cinematic filming services for weddings and other memorable occasions (“Goods and Services”).

Provision of Goods and Services

These Terms and Conditions (the “Terms”) represent the sale and provision of Goods and Services by Us and will form the basis of the Contract between Us and our customers (“You”). Before submitting an Order, please ensure that you have read these Terms carefully. If you are unsure about any part of these Terms, please ask Us for clarification.

Your Order constitutes a contractual offer that We may, at our discretion, accept. A legally binding contract between Us and you will be created upon our acceptance of your Order, to purchase our Goods and Services (“Order”) indicated by Our Order Confirmation. Any such Order Confirmation will be provided in writing to you either by email or by post.

By placing an Order with us, You will acknowledge that you have read and fully understand the terms of the wedding contract and realise that this contract becomes effective immediately.

These Terms do not affect your statutory rights.

Booking Form

Our booking form is incorporated in to these Terms and will be legally binding.

It is mutually agreed that the filmmaker shall supply the services and goods specified in the Booking form, and that the client shall pay the price agreed by email.

Payment

The full payment is due to secure the date and will be payable by You upon receipt of our invoice. Accepted methods of payment are BACS, cheque (payable to A Ireland-Wolfe) or cash. Please note that title in the Goods and Services will not be transferred until We have received payment in full.

Travelling Expenses

All packages include travel expenses up to 60 miles from our studio (TN2). For distances greater than this we reserve the right to charge for any extra motoring or rail expenses.

Cancellation

You have the right to cancel this Order within 14 days of placing it with us in accordance with your statutory rights and this is the only occasion, We will refund any deposit paid by You.

Notwithstanding the above, You may cancel this contract at any time prior to the event by giving written notice to Final Farewell Films and the deposit will be retained by Us, with no further fees payable.

COVID19 – If Government rules mean the event is unable to take place at all due to the event date falling into a period of lockdown (as defined by the Government, but currently a three week rolling notice period) then Final Farewell Films will return all monies paid by the client (less reasonable expenses for work done), or work with the client to find a suitable replacement date. This only comes into force once the event date falls within the period of lockdown as defined by the Government and is not retrospective i.e. the client cannot claim the event was cancelled due to Government lockdown if they cancel before the event date is confirmed to be in the period of lockdown, even if the event date does then subsequently fall into the lockdown period.

If the client wishes to change the agreed event date due to the event being unable to take place due to Government lockdown, or if social distancing guidelines are still in force (but the event can legally go ahead) then Final Farewell Films and the client agree to find a mutually agreeable date to reschedule to within one year of the original event date. All payments will be put towards the new date but the client agrees to continue on the existing payment schedule of full balance payment one month prior to the original event date.

Final Farewell Films will not charge any additional fees for moving the event date within the one year time period. Weddings re-booked further than one year out may incur additional fees in line with package changes.

Final Farewell Films reserves the right to charge travel, subsistence and accommodation costs if a new venue is booked which is not in the same 2 hour geographical area as the original event venue.

If the client decides to fully cancel the event solely due to social distancing being in place then normal cancellation rules apply.

Coverage

We will try to ensure that your video is filmed without a hitch. However, We are of course all subject to things that may happen beyond our control.

Coverage will be as the cameraman’s professional expertise determines and no one scene will be determined more important than another. Final Farewell Films cannot guarantee coverage of any particular event or individual on the day.

We use broadcast quality well maintained equipment, however We are not liable for any radio signal losses, battery failure, equipment failure or material defects which are beyond our control. Every reasonable effort will be made to arrange a replacement cameraman should it be necessary to do so.

In the unlikely event of a total video failure our liabilities are limited to a refund of all monies paid by the client. Final Farewell Films also recommends all clients to purchase adequate insurance to cover such instances.

The Edit

Final Farewell Films aims to send the preview film at a maximum of 2 weeks from the event date. Up to 3 small changes are accepted and any additional changes may be subjected to a charge.

We will archive a client’s film at 12 months from the event date, after this, further editing changes will not be accepted.

The USB’s and DVDs provided are DVD-R and standard formatted USB which are compatible with most DVD players, computers and TV’s. We ask clients to check the compatibility of their player before booking our services.

Music and Licensing

It is your responsibility to ensure that the correct licenses have been purchased for their church ceremony, musicians and entertainers. (PRS for Music)

Commercial music can be chosen for the film but must be password protected should the intended use to be online. We recommend that if the client requires their film to be online to choose our music licensing option so a licensed music track can be purchased.

 Recommendations

You are advised to inform the venue that You intend to have the event filmed. This avoids the disappointment of being refused on the day. If this situation occurs Final Farewell Films will not refund any payment.

We strongly advise that back-ups of the USB/ DVD provided are made as soon as they are received. Should they become corrupted due to misuse Final Farewell Films will charge a replacement fee.

Copyright

At all times, We retain the copyright of all the videography produced and all the original files remain the property of A Ireland-Wolfe. It is not our policy to provide the raw footage to clients or third parties.

Any video content on the web is restricted to Final Farewell Films only. Video conversion, web streaming and other delivery of Final Farewell Films content by third parties is not permitted.

General

We shall have no responsibility or liability for any failure to perform, or delay in performance or any of our obligations under the Terms that is caused by events outside of our control.

You may not assign your rights and obligations under these Terms to any party, and any purported attempt to do so will be null and void. We may transfer (assign) our obligations and rights under these Terms (and under the Contract, as applicable) to a third party (this may happen, for example, if we sell our business). If this occurs, You will be informed by us in writing. Your rights under these Terms will not be affected and our obligations under these Terms will be transferred to the third party who will remain bound by them.

If any part of these Terms is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.

No failure or delay by Us in exercising any of Our rights under these Terms and Conditions means that We have waived that right, and no waiver by Us of a breach of any provision of these Terms and Conditions means that We will waive any subsequent breach of the same or any other provision.

These Terms, the Contract, and the relationship between You and Us (whether contractual or otherwise) shall be governed by, and construed in accordance with English law and subject to English jurisdiction.
